AGB (General Terms and Conditions)

§ 1 General
The following Terms and Conditions (in the following called "TC") apply to all contracts the customer concludes with MAZ Sound Tools GmbH (in the following called "MAZ"), especially in the MAZ online shop. Valid is the version of the TC at the time of the completion of the contract. The present TC are valid exclusively, divergent regulations require the previous written consent by MAZ. Valid law is the one of the Federal Republic of Germany under exclusion of the UN purchase rights. Chemnitz is the place of performance. If the customer is a merchant according to the german HGB, Chemnitz is the place of jurisdiction. If a part of this agreement should be ineffective, the rest of the agreement remains effective.

§ 2 Contract conclusion
The offers of the MAZ online shop are without obligation and without engagement. By submiting the order the customer enforceably assures MAZ that (s)he wants to purchase the contents of the shopping basket. The sales contract becomes effective by sending the eMail-invoice to the customer.

§ 3 Information obligations
The customer is obliged to indicate the true and complete address data necessary for the successful delivery of the product(s). If the product is delivered in physical form (CD/DVD) a valid postal address is required. If the product is delivered in electronic form (registration key/password/download) a working eMail-address is required.

We consider the address data to be faulty if a physical delivery failed because of undeliverability, or if the eMail of an electronic delivery bounced at least three times, because of the eMail-account doesn't exist or is over quota. MAZ obliges to inform the customer about the state of the order incl. payment and delivery of the product, except the customer waives this by entering an obviously incorrect eMail address. If an ordered product should temporarily be undeliverably MAZ will immediately inform the customer about it on receipt of the order by eMail, as well as in the following period at regular intervals.

§ 4 Order handling / delivery
Before submiting the order the shop shows a summary of the order data to the customer. After submiting the order the customer receives an eMail with identical content. The purchase price immediately becomes due with submiting the order. It can by payed either by Cash On Delivery (COD) or prepaid (credit card, bank transfer / wire, cheque, cash). We will arrange the dispatch of the product(s) immediately at the day of the incoming payment (COD: incoming order), or at the latest 3 working days after receiving the payment (COD: receiving the order). Physically delivered products will be shipped by Airmail (exception: inside Germany) to the given postal address, electronically delivered products will be shipped to the given eMail address. If a delivery delay should appear we are liable exclusively for damages caused by a roughly negligent or deliberate behaviour on our part. In the case of a delay the customer is authorized to withdraw from the contract, provided he has fruitlessly set us a deadline for the delivery before. If an ordered product should not longer be deliverably in the foreseeable future MAZ will immediately inform the customer about it by eMail. In this case MAZ as well as the customer are authorized to withdraw from the sales contract. In this case MAZ obliges to immediately reimburse an already received payment back to the customer.

§ 5 Prices / terms of payment
All prices are gross prices. The base currency for the price specification is Euro. If the customer chooses a different currency in the shopping basket, the shown product prices are subject to the fluctuations of the currency conversion. The price shown at the time of the order is valid for this order. For payment by credit card the due fund of your credit card is debited. Your credit card company converts the euro fund to your currency to the current current price.

For payment by credit card the due fund will be debited from your credit card. Your credit card company will convert the Euro fund to your currency, using the current currency conversion rate.

For payment by bank transfer / wire the fund should be transfered to the following bank account, mentioning your name and the order date at your banks remittance form:

For payment by cash or cheque the due fund should be sent in an envelope at the risk of the customer ("registered post" recommended) to the postal address MAZ Sound Tools GmbH, Matthias Ziegs, Scharnhorststr. 1, 09130 Chemnitz, Germany.

For payment by COD (cash on delivery) the due fund is collected by the engaged delivering service in your national currency on delivery. If the customer should not fetch an ordered COD package or refuse its acceptance MAZ will charge a flat-rate fee of 7 Euro on delivery within Germany or 20 Euro for international shipping.

$ 6 Data protection / security
All user data input, incl. credit card or bank account data, is protected by an encrypted SSL connection. Your data can be neither bugged nor changed by third parties during the ordering process. By submitting the order the customer allows MAZ to store the data required for handling this order by the help of electronic data processing. These data are confidentially treated of course, and only used for handling the order and other contractual relations to the customer. Customer data aren't passed on to third parties, only exception is the order of a product which is delivered directly by the manufacturer (at present: MadTracker). During the ordering process the customer might be asked for additional personal details, such as installed soft- or hardware, telling these details is voluntary.

§ 7 Revocation right
Private end-consumers are authorized to withdraw from the order without telling a reason within two weeks upon receipt of the product. For products delivered in electronic form (registering key/password/download) the revocation right is excluded due to the nature of the product, please use the possibility of downloading and testing the free demo version before the purchase. For software provided on a physical medium (CD/DVD) the revocation right is excluded, as soon as the shrink-wrap of the product has been opened. If the product has been customized to special needs of the customer differing from the offer of the online-shop the revocation right is excluded too.

The revocation can be done within 2 weeks by returning the complete original package in time (postmark counts) to MAZ Sound Tools GmbH, Matthias Ziegs, Scharnhorststr. 1, 09130 Chemnitz, Germany, or by an eMail notification to followed by returning the complete original package within two weeks after sending the eMail notification. The customer bears the shipping costs of the return for goods values up to 40 Euro, unless the delivered product isn't the ordered product. For goods values above 40 Euro MAZ refunds the shipping costs on receipt of the return for the currently cheapest shipping type, (incl. "Airmail" option for countries outside of Germany). Unfortunately, carriage forward shipments ("receiver pays") cannot be accepted, since this adds unnecessary costs (2 Euro service charges + big package postage, even for simple letters).

After receiving the revocation and the returned products in time the already paid purchase price is refunded by transfering it to a bank account of the customer, incl. the shipping costs of the return shipping disbursed by the customer.

§ 8 Warranty and liability
The warranty details follow the legal regulations in Germany with stipulation of the following regulations. The customer is obliged to immediately examine the product for defects upon receipt and to immediately report found defects by eMail to . Obvious defects have to be reported within 7 days upon receipt of the product at the latest, hidden defects at the latest within 2 years. If the customer refrains from reporting MAZ about defects within the mentioned periods (s)he can not longer assert warranty claims against MAZ about these defects. In case of a defect MAZ is authorized to deceide between re-delivery or correction. If the correction finally fails or the re-delivered product got defects too, the customer is authorized to demand for a return of the product incl. a full refund of the purchase price.

MAZ is liable for damages caused by intention or gross negligence. Furthermore MAZ is liable according to the german product liability law. Any further claims shall be excluded. In the case of only a slight degree of negligence, the liability of MAZ is limited to the type and the amount of the typically foreseeable damage, which shall not exceed the total amount of the purchase price. MAZ particularly isn't liable for damages which didn't arise at the delivered products themselves, nor for loss of profit or other consequential damages. MAZ isn't liable for faults whose appearance was caused by the customer, such as ordinary wear and tear phenomena.
